Terms of Service

1. Acceptance of these Terms

By creating an account, tapping "I agree", or using the Service you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

We record the version and date of the Terms you accepted. If we make material changes we will show you the updated Terms in the app and, where required, ask you to accept them again before continuing.

2. Eligibility and age

You must be at least 16 and legally able to enter into a contract to use the Service. NomNom tracks calories, body weight and related wellness information and is not designed for children.

If you are under the age of majority where you live, you may only use the Service with the consent and supervision of a parent or guardian who agrees to these Terms on your behalf.

3. Your account

You need an account (email address and password) to use NomNom. You are responsible for keeping your password confidential and for all activity under your account. Tell us at support@nomappsllc.com immediately if you believe your account has been compromised.

You may set a display name, a public username and a custom name for your Nom character. Usernames may be seen by other users through the friends features; do not use names that impersonate others or are offensive.

4. What NomNom does

NomNom is a nutrition and wellness companion. It lets you log food (by search, barcode, photo, typed description or saved meals), water, exercise, body weight and an optional daily feeling check-in; it calculates estimated calorie and macronutrient targets; it suggests meals; it shows progress charts; it lets you connect with friends; and it animates a character ("Nom") that reacts to your entries.

Nom's reactions, levels, streaks, achievements and cosmetics are entertainment and motivation features only. They are not assessments of your body, health or worth.

5. Not medical advice

NomNom provides general nutrition and wellness information for educational and informational purposes only. Nothing in the Service is medical, dietetic, psychological or other professional advice, diagnosis or treatment, and no doctor–patient or similar relationship is created.

Calorie, macronutrient, hydration and target values are estimates produced from published population formulas (for example Mifflin-St Jeor) and food databases. They may be wrong for you. Always consult a qualified healthcare professional before changing your diet or exercise, especially if you are pregnant, breastfeeding, under 18, have a history of disordered eating, or have any medical condition.

Daily feeling check-ins (for example "tired" or "sick") only change how Nom looks and what encouragement you see. NomNom never diagnoses conditions, and you should seek medical care for any health concern. If you are struggling with food or body image, please contact a healthcare provider or a local support line.

6. Estimated nutrition information and AI features

Nutrition values come from third-party databases (USDA FoodData Central and Open Food Facts), from manufacturers via barcodes, from your own manual entries, and from artificial-intelligence estimates when you scan a photo, describe a meal in words, or ask "What should I eat?". AI output is clearly labelled as an estimate. AI can misidentify foods, portions and ingredients; you must review and correct results before relying on them.

Meal suggestions consider the dietary preferences and allergies you entered, but they are generated automatically and may still contain ingredients you should avoid. You are solely responsible for checking ingredients and allergens. Free accounts have daily limits on AI features; limits are shown in the app and may change.

7. No guarantee of results

We do not promise any particular health, fitness, weight-loss, weight-gain or performance outcome. Results depend on many factors outside the Service. You use NomNom at your own risk.

8. Information you provide

You are responsible for the accuracy of what you enter, including body measurements, goals, allergies, food entries and feeling check-ins. Only enter information about yourself, or about another person if you have their permission. Do not upload photos that contain other people's faces or sensitive documents.

9. Location

NomNom currently does not request or use your device location. If we add location-based features in the future (for example nearby restaurants), they will be optional, will ask for your permission first, and these Terms and the Privacy Policy will be updated before launch.

10. Subscriptions, billing and renewal

NomNom Premium is an optional auto-renewing subscription (monthly or annual) purchased through the Apple App Store or Google Play. Prices are shown in the app before purchase and may vary by region. Payment is charged to your store account at confirmation of purchase.

Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before the period ends. You can manage or cancel in your App Store or Google Play subscription settings; deleting the app or your NomNom account does not cancel a store subscription.

If a free trial or introductory price is offered, it is described at the point of purchase; any unused portion of a free trial is forfeited when you purchase a subscription. Subscription entitlements are managed with RevenueCat and are tied to your NomNom account; use "Restore purchases" to recover an active subscription on a new device.

11. Refunds

Purchases are processed by Apple or Google under their terms. Refund requests must be made through the store where you purchased (Apple: reportaproblem.apple.com; Google: Play Store order history). We do not control store refund decisions. Where local consumer law gives you additional refund rights, those rights apply.

12. Intellectual property

The Service, including the Nom character, its outfits, artwork, animations, name, text, software and design, is owned by Nom Apps LLC or its licensors and is protected by copyright, trademark and other laws. We grant you a limited, personal, non-transferable, revocable licence to use the app on devices you own or control, for your own non-commercial use.

Food database content is provided under the terms of its respective sources (USDA FoodData Central is public domain; Open Food Facts data is available under the Open Database License).

13. Your content

You keep ownership of the photos, text and other content you submit. You grant us a worldwide, non-exclusive, royalty-free licence to store, process, display and transmit that content solely to operate and improve the Service for you (for example sending a meal photo to an AI provider to estimate nutrition, or showing your achievement post to your friends according to your privacy settings).

You confirm you have the rights to anything you upload and that it does not violate the law or anyone else's rights.

14. Acceptable use

You agree not to: use the Service for anything unlawful; harass, bully or shame other users (including comments about their body or eating); upload sexual, violent, hateful or otherwise objectionable content; impersonate anyone; attempt to access other users' data; reverse engineer, scrape, overload or interfere with the Service; use automated tools to create accounts or send requests; circumvent free-tier limits or subscription checks; or use the Service to promote disordered eating.

Friends features let you send requests, react to posts ("high five") and block users. Block anyone who makes you uncomfortable and report abuse to support@nomappsllc.com.

15. Third-party services

The Service relies on third parties, including: Emergent (application hosting, database hosting and the gateway through which AI requests are sent), OpenAI models (food photo recognition, meal descriptions, meal suggestions and interpretation of free-text feeling check-ins), USDA FoodData Central and Open Food Facts (food data), RevenueCat together with the Apple App Store and Google Play (subscriptions and payments), Apple and Google push-notification services and Emergent's push relay (notifications), and Emergent Object Storage (private storage of meal photos). Their availability and accuracy are outside our control, and their own terms may apply to you.

16. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT NUTRITION ESTIMATES, AI OUTPUT, TARGETS OR SUGGESTIONS ARE ACCURATE, COMPLETE OR SUITABLE FOR YOU, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE. Some jurisdictions do not allow these exclusions, so they may not apply to you.

17. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, NOM APPS LLC AND ITS OFFICERS, EMPLOYEES AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, HEALTH OUTCOME, PROFITS OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR USD 50. Nothing in these Terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, fraud, or consumer rights that cannot be waived.

18. Suspension and termination

You can stop using NomNom at any time and delete your account from You → Account → Delete account. We may suspend or terminate your account if you breach these Terms, create risk or legal exposure for us or other users, or if we discontinue the Service. On termination your licence ends; sections that by their nature should survive (including intellectual property, disclaimers and limitation of liability) survive.

19. Changes to the Service and to these Terms

We may add, change or remove features, limits and prices. We may update these Terms; the current version and effective date are always shown in the app. Material changes will be presented for acceptance in the app. Continuing to use the Service after non-material changes means you accept them.

20. Governing law and disputes

These Terms are governed by the laws of the State of Wisconsin, without regard to conflict-of-law rules, and disputes will be brought in the courts of Wisconsin, unless mandatory consumer-protection law where you live provides otherwise.

21. App store terms

If you downloaded NomNom from the Apple App Store, Apple's Licensed Application End User License Agreement also applies and Apple is a third-party beneficiary of these Terms with the right to enforce them against you; Apple has no obligation to provide maintenance or support. If you downloaded from Google Play, the Google Play Terms of Service also apply.
